RESUMEN: Este artículo parte de la doctrina de la intersubjetividad como base del concepto de derecho en Fichte y Hegel. Se muestra que esa teoría no sólo constituye una relación formal (transcendental o pragmático-lingüística) entre las conciencias, sino que contiene una dimensión real en tanto que crítica de la economía política (libre mercado). En Fichte, la vinculación entre reconocimiento y propiedad comporta un modelo económico planificado; en Hegel, implica la necesaria intervención del Estado para corregir la dinámica destructiva de la sociedad civil. El legado de ambos es así determinante en la elaboración conceptual del Estado social/ socialista de derecho.

ABSTRACT: This paper parts from the doctrine of intersubjectivity as the basis of the concept of law in Fichte and Hegel. It is shown that this theory not only constitutes a formal relationship (transcendental or pragmatic-linguistic) between consciences, but also contains a real dimension as a critique of political economy (free market). In Fichte, the link between recognition and ownership involves a planned economic model; in Hegel, it implies the necessary intervention of the state to correct the destructive dynamics of civil society. The legacy of both is thus decisive in the conceptual elaboration of the social/socialist state of law.
