Abstract

This paper parts from the doctrine of intersubjectivity as the basis of the concept of law in Fichte and Hegel. It is shown that this theory not only constitutes a formal relationship (transcendental or pragmatic-linguistic) between consciences, but also contains a real dimension as a critique of political economy (free market). In Fichte, the link between recognition and ownership involves a planned economic model; in Hegel, it implies the necessary intervention of the state to correct the destructive dynamics of civil society. The legacy of both is thus decisive in the conceptual elaboration of the social/socialist state of law.
